The chapter is part of a comparative research on the topic of sexual offences. In regard to this type of crimes, significant criminological information has emerged in various European States, that is a significant discrepancy between the number of complaints submitted to public authorities and the number of actual criminal convictions. As part of a survey investigating the factors that may contribute to this result, the chapter progresses with reference to the Italian legal system. Developing from an analysis of the criminal rules and recent judicial cases on the issue, the objective is to highlight the specific aspects of sexual offences committed in the context of close relationships. These crimes are characterized by factors inherent to the personal relationship between the subjects involved. The essay aims to emphasize how the victims’ psychological vulnerability, the lack of economic resources and social isolation could be an obstacle to the development of the criminal proceedings.

Il contributo si inserisce in una ricerca di tipo comparatistico in materia di reati sessuali. Rispetto a questa tipologia di reati, in vari Stati europei è emerso un dato significativo sul piano criminologico, ossia l’esistenza di un divario tra il numero di denunce presentate alle autorità pubbliche e il numero delle condanne effettivamente inflitte. Nell’ambito di un’indagine circa i fattori che possono contribuire a questo risultato, il Capitolo prende in considerazione una delle più complesse forme di manifestazione della violenza sessuale, ossia quella commessa nelle relazioni personali, familiari e affettive. L’indagine si sviluppa con riferimento all’ordinamento giuridico italiano. A partire da un’analisi delle norme penali coinvolte e di alcuni recenti casi giudiziari, si evidenziano le specificità dei reati sessuali commessi all’interno di relazioni strette (close relationships), i fattori di vulnerabilità fisio-psichica che caratterizzano le persone offese e il loro impatto sullo svolgimento e sull’esito dei procedimenti penali.
