Moving from a document found in the Archive of Naples, this study considers the correct application of the art. 2063 of the Napoleonic code, concerning personal imprisonment for debt. The procedural memories written by the Attorney General at the Court of Cassation Giuseppe Raffaelli and by the Attorney General at the Court of Appeal of Naples Amodio Ricciardi incorporate two opposite interpretations, allowing us to explain the main elements characterizing neapolitan legal culture at the beginning of the legalistic experience. The mainly franconcentric exposition does not prevent us from tracing the persistency of a modus operandi originated before the promulgation of the french code and that characterized neapolitan legal culture even after the end of Napoleonic period.
