The article aims to analyse the impact of the reform of the Economic and Monetary Union (EMU) on the relationship between the European and the national legal orders. Following the outbreak of the sovereign debt crisis, the pursuit of stability of the single currency and of the euro area as a whole convinced EU institutions to use all available options under the current Treaties to develop crisis management policies and strengthen their supervision on the management of national competences, in particular fiscal policy. At the same time, Member States have preferred to stipulate intergovernmental agreements beyond EU law in order to establish stabilisation tools under their strict control. These reforms have consolidated the hybrid nature of the EMU, between EU and international law, and put under considerable stress the relationship between the primacy of EU law and the protection of national constitutional identity. Domestic courts and the European Court of Justice have tried, despite difficulties, to re-establish a balance between legal orders by innovatively interpreting existing laws and updating some aspect of their previous case law.

L’articolo intende analizzare l’impatto del processo di riforma dell’Unione economica e monetaria (UEM) sul rapporto tra ordinamento europeo ed ordinamenti nazionali. In seguito allo scoppio della crisi del debito sovrano, il perseguimento della stabilità della moneta unica e della zona euro ha spinto le istituzioni UE ad usare tutti i margini di manovra offerti dai Trattati per sviluppare politiche di gestione della crisi e rafforzare la loro supervisione sull’esercizio di alcune competenze nazionali, in particolare la politica fiscale; allo stesso tempo gli Stati membri hanno stipulato accordi internazionali al di là del diritto UE per creare meccanismi di stabilizzazione sotto il loro stretto controllo. Queste riforme hanno rafforzato la natura ibrida dell’UEM, sempre più a metà tra diritto UE e diritto internazionale, mettendo sotto tensione il rapporto tra il principio del primato del diritto europeo e la tutela dell’identità costituzionale degli Stati membri. Alcune pronunce delle Corti nazionali e della Corte di giustizia dell’Unione europea hanno cercato di ricomporre, non senza difficoltà, l’equilibrio tra gli ordinamenti grazie ad una nuova interpretazione del diritto vigente e rivedendo alcuni aspetti della loro giurisprudenza pregressa.

Abstract
