La cura delle norme. Oltre la corruzione delle regole e dei saperi

The state of criminal justice is a mirror of the moral health of a society. When his ways and fields of intervention exceed certain levels, we are faced with a cultural, not just legal, pathology, which lies in such 'surplus' of sanctions blatantly exhibited, but often lacking any effectiveness (especially where they should have more): symptom of the regression to a primitive condition, 'sacrificial', anxious to find scapegoats before understanding problems and really willing to solve them. This is also, in a sense, a kind of corruption affecting legal and social rules, which is at the same time the cause and effect of public and private corruptions as crimes, addressed in Italy by recent law reforms, but which continue to be a heavy burden for the country and especially its young people. However, it is not from the umpteenth legislative reform that we can expect a "healing" from such a tangle of corruption. Above all, it is necessary to take care of legal and non-juridical norms: a task for everyone, because everyone - individual or institution - should be endowed of at least some of that 'nobility of spirit' necessary to turn his gaze back to the light of knowledge, namely to that right and just knowledge stemming from the ability to really listen to the stories of people and communities and to remove the diabolical divisive temptation of violence and deception. The kind of light which can inspire not the impatient Faust (in the Goethe’s poem) , but Iphigenia, a wonderful witness of ethical humanism and the main character of another great work by J. Wolfgang Goethe’s:. Around this great German writer (and jurist) in love with Italy, who "knew no resentment", the book knots the threads of a passionate and regenerating dialogue between literature and law, weaves a web of paths among which the reader is invited to find the way for himself to respond to the great demand for justice that never ceases to challenge every human being worthy of the name.

Lo stato della giustizia penale è lo specchio della salute morale di una società. Quando i suoi modi e campi d’intervento superano certi livelli di guar­dia, ci si trova di fronte a quella patologia culturale, prima ancora che giuridica, che è l’‘eccedenza’ di sanzioni vistosamente esibite, ma spesso prive di efficacia (specie dove invece dovrebbero averne di più): sintomo della regressione a una condizione primitiva, ‘sacrificale’, ansiosa di trovare capri espia­tori prima di capire e di saper vedere i problemi. Ciò costituisce anche una forma di corruzione delle regole di convivenza, la quale è al contempo cau­sa ed effetto della corruzione propriamente detta, pubblica e privata, a cui con leggi recenti si è cer­cato di porre rimedio, ma che continua a pesare come un macigno sul futuro del Paese e special­mente dei suoi giovani. Non è però dall’ennesima riforma legislativa che ci si può attendere la ‘gua­rigione’ da un tale groviglio di corruzioni. Occorre soprattutto prendersi cura delle norme, giuridiche e non: un compito per tutti, perché ognuno – indivi­duo o istituzione – dovrebbe dotarsi almeno un po’ di quella ‘nobiltà di spirito’ necessaria per volgere nuovamente lo sguardo verso la luce del sapere e dei saperi, giusti in quanto capaci di ascoltare ve­ramente le storie delle persone e delle comunità e di allontanare la diabolica tentazione divisiva del­la violenza e dell’inganno. Luce cui sa ispirarsi non l’impaziente Faust, ma Ifigenia, testimone meravi-gliosa di umanesimo etico e protagonista del dram­ma omonimo di J. Wolfgang Goethe. Attorno a questo grande scrittore (e giurista) tedesco innamo­rato dell’Italia, che “non conosceva risentimento”, il libro annoda i fili di un dialogo appassionato e rigenerante tra letteratura e diritto, tesse una tra­ma di percorsi tra i quali il lettore è invitato a trova­re da sé la via per rispondere alla grande doman­da di giustizia che non smette di interpellare ogni essere umano degno di questo nome.
