Flessibilità e sicurezza dopo il Jobs Act. La flexicurity italiana nell'ordinamento multilivello

The volume deals with flexicurity, ten years after the adoption by the European Union. The objective is to measure distances and influences with regard to that formulation, with a particular attention to the most recent reforms of Italian Labour Law (the so called Jobs Act). The main idea held in the book is that the European approach of flexicurity allows the Member States to apply different combinations of flexibility and security in their national systems of labour law and that the model chosen by the Italian legislator is one of the possible options, and even not fully consistent with the principles established in 2007. After comparing Italian and German reforms on the subject, the author, while concluding the volume, wonders if flexicurity is a suitable strategy to face the challenges of the so called "Work 4.0", and gives a positive answer.

Il volume affronta il tema della flexicurity a circa un decennio dal varo dei “Principi comuni” da parte dell’Unione europea. L’obiettivo è quello di misurare distanze e influenze rispetto a quella formulazione, con lo sguardo rivolto in particolare alle più recenti riforme del diritto del lavoro italiano (il cd. Jobs Act). La tesi principale sostenuta nel libro è che l’approccio europeo di flexicurity consente declinazioni diverse del binomio di flessibilità e sicurezza nei diritti nazionali del lavoro e che la variante scelta dal legislatore italiano costituisce una tra quelle possibili, peraltro non del tutto rispondente ai pur vaghi principi stabiliti nel 2007. Dopo una comparazione tra riforme italiane e tedesche in materia, l’autore non manca di interrogarsi, a chiusura del volume, su un aspetto di attualità: se la flexicurity costituisca una strategia adatta ad affrontare le sfide del cd. “Lavoro 4.0”. E dà una risposta affermativa.
