This essay addresses from a philosophical-legal perspective the concept of ‘gift’ and its close relation with the communitarian dimension. Starting from the theory elaborated by René Girard, in particular his idea of ‘scapegoat’, it is possible to highlight three dimensions of the gift: the gift as a social fundament, the gift as a violence dimension and the gift as a politicalinstitutional bond. This theoretical model allows to compare the gift and the communitarian dimension, paradigmatically the Greek experience and the early Christian communities, and to clarify the dialectical relation between the nexus gift-community and law (also with regard to New Philanthropy). In spite of the current opposition between donative agency and strategicinstrumental reason, the relation gift-law should be understood in a more complex manner. Having an immediate and direct social-institutional projection, gift intrinsically ‘creates law’: more widely it implies the implementation of a political-legal bond.

Abstract
Having an immediate and direct social-institutional projection, gift intrinsically ‘creates law’: more widely it implies the implementation of a political-legal bond.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
