UNA ISTITUZIONE DELLA DEMOCRAZIA. IL PARTITO POLITICO NELL'ORDINAMENTO REPUBBLICANO

The aim of this study is to examine the constitutional position of political parties in accordance with art. 49 of the Italian Constitution. The interest for these groups, an ancient but living matter, is motivated by both the violent criticism against them and by their role, which remains fundamental. This study defends, from a “neo-liberal” point of view, the importance, in the republican system, of these institutions, which are considered to be necessary in a solid and mature representative democracy. At the same time, it asserts the constitutional need – and the possibility, of course – for a regulation that is able to guarantee the democratic nature of the parties’ work, even inside their internal activities, without focusing only on issues such as funding or inspections on the source and destination of the assets of these organizations. This regulation aims to protect the rights of the individual inside the parties and to value their role in accordance with the Constitution.

Il lavoro indaga il tema della posizione costituzionale dei partiti politici ai sensi dell’art. 49 della Costituzione. L’interesse per tali soggetti, antico ma sempre attuale, è motivato dalla violenza delle critiche da cui sono investiti e, al contempo, dal loro ruolo tuttora centrale. In una prospettiva che si potrebbe definire neo-liberale, la tesi difende la centralità, nel sistema repubblicano, di queste istituzioni, ritenute indispensabili in una matura democrazia rappresentativa; al contempo, è affermata la necessità – e certamente la possibilità – costituzionale di una legislazione che garantisca la democraticità dell’attività dei partiti, anche nella loro vita interna, senza limitarsi alla questione del finanziamento e ai controlli sulla provenienza e sulla destinazione delle risorse economiche di queste organizzazioni. Ciò al duplice scopo di tutelare effettivamente i diritti del singolo all’interno dei partiti e di valorizzare il ruolo che la Costituzione assegna loro.
