IL PRINCIPIO DI PROPORZIONALITA' NEGLI ASPETTI PATRIMONIALI DELL'INVESTIMENTO SOCIETARIO

The thesis analyzes the principle of proportionality between the extent of the company ownership and the extent of the related property rights. The dissertation is divided, on the one hand, considering the legal instruments that allow the deflection from the abovementioned principle and, on the other hand, investigating the systematic limits that constrain company members’ freedom in such process of deflection.

La tesi analizza il principio di proporzionalità tra la misura della partecipazione sociale e la misura dei diritti patrimoniali ad essa connessi. L’indagine si articola, da un lato, vagliando gli strumenti giuridici che consentono la deviazione dal principio suddetto e, dall’altro, indagando i limiti sistematici che vincolano la libertà dei soci in tale processo di deviazione.
