The proper object of philosophy is to understand the world also critically taking into consideration the reliability of concepts, ideas and inferences. To legal sciences the philosophical reflection upon abductive inference is certainly relevant, since abduction it is better suited than formal logic to grasp the creativity moment by which a problematic context comes to comprehension. Abduction receives special attention in systemic thinking as the inference mostly used in reality conditions of knowledge, exercised almost always in those contexts where only an incomplete information is available. Abduction surdetermines the available – and incomplete – data in a new configuration offering a solution to the problem in course of investigation. Being both «creative» and «rational», it must be recognized as depending also from the personal characteristics of the subject, including his-her history, his-her judgments, his-her culture. All this must be admitted without diminishing the reality foundations of knowledge and its rational reliability.
