The Author addresses end-of-life issues so as to take into account the points of view of the subjects involved in these situation as provided for in art. 32 of the It. Const. This is done in order to satisfy the necessity of personalized therapies and the appropriateness of medical treatments. Starting from here, the Author analyses informed consent in the light of the social function that can be recognised to the medical profession and a distinction between the patient's refusal or initial dissent and the refusal to continue a treatment that has already been started. The Author goes on to underline the aporetic implications of transposing, without due adaptation, private autonomy (and representation) from the context of patrimonial rights to individual rights.
Il saggio prende in esame le questioni del fine vita analizzandone i riflessi sulla relazione tra medico e paziente a partire dal profilo metodologico generale, i valori costitutuzionali in gioco e le principali categorie giuridiche in questione. Valorizza la distinzione tra rifiuto e rinuncia per distinguere tra manifestazioni della volontà con le quali una persona non accetta un intervento medico ancora non iniziato e manifestazioni della volontà rivolte a interrompere un trattamento medico in atto. Affronta altresì il tema del consenso informato con riguardo sia alle persone capaci sia alle persone incapaci problematizzando la questione della ricostruzione della volontà mai espressa dal soggetto sulla base di una ricostruzione della personalità dello stesso. Esamina infine gli aspetti problematici di un'eventuale indebita trasposizione di modelli negoziali di matrice patrimonialistica sul piano dei diritti della personalità.
