The European model of migratory flows’ management, traditionally based on the guest worker’s image, has procrastinated the question of foreigners’ inclusion into the framework of citizenship rights, namely the question of welfare’s boundaries. The evolution of migrations, their transformation into a stable and composite presence, and above all the emergence of a second generation, have forced European countries to enrich the hamper of rights acknowledged to migrants and their families. Anyway has not led to the resolution of the historic paradox of the European experience: the attempt to keep together the economic logic on which the European model of entries regulation is based, with the olidarity logic that stresses the primacy of personhood on the States’ prerogative to “choose” their citizens and to decide foreigners’ treatment. An attempt that has always produced compromising solutions which show, at the same time, the nature of cultural and political artefact of national citizenship and the paradoxical outcomes resulting from the application of the logic of means-tested access to rights.

Il modello europeo di regolazione dei flussi migratori, tradizionalmente fondato sulla figura del lavoratore ospite, ha consentito di posporre nel tempo la questione dell’inclusione degli stranieri nel sistema dei diritti di cittadinanza, cioè a dire la questione dei “confini” del welfare. L’evoluzione del fenomeno migratorio, la sua trasformazione in una presenza stabile ed eterogenea, a maggiore ragione la comparsa di una seconda generazione hanno costretto i paesi europei ad arricchire il paniere dei diritti offerti agli immigrati e alle loro famiglie, senza però risolvere in modo definitivo il paradosso storico della vicenda europea: il tentativo di tenere insieme la logica economicista alla base del modello europeo di regolazione degli ingressi con quella solidaristica che afferma il primato dei diritti della persona sulla stessa prerogativa degli Stati di “scegliersi” i propri cittadini e decidere il trattamento da riservare agli stranieri. Un tentativo che, oggi come ieri, esita in soluzioni compromissorie che rivelano, ad un tempo, il carattere di artefatto politico e culturale del concetto di cittadinanza nazionale e gli esiti paradossali cui può condurre l’applicazione di una logica di condizionalità nell’accesso ai diritti.
