The article analyses two topics (which are related but also distinct): “teleworking” and “smart working”, within the structure of Public Administration as employer. These two institutes are analysed from a legal point of view, evaluating the steps that brought to the current regulating framework and, also, deepening the (non pacific) distinction between these two contractual types. However, it’s important to keep in mind that the evolution of “telelworking” and “smart working” must be placed in the wider issue of the organization of the Public Administration, especially referred to the themes of innovation and performance measurement
